The agreement governing your use of Fluenx services.
These Terms of Service ("Terms") govern your access to and use of Fluenx Inc.'s ("Fluenx," "we," "us") website, applications, and financial technology services (the "Services"). By creating an account or using the Services, you agree to be bound by these Terms.
You must be at least 18 years of age, capable of forming a binding contract, and not prohibited from using the Services under applicable law to open a Fluenx account. Identity verification must be completed before certain features are made available.
Fluenx provides multi-currency virtual accounts, currency conversion, and related money movement tools. Fluenx operates as a financial technology company, not a bank. Banking and money movement services made available through Fluenx are provided in partnership with licensed financial institution partners. Funds held through the Services may be eligible for pass-through deposit insurance as made available through those partners, subject to their terms.
Federal law requires financial institutions and their partners to obtain, verify, and record information that identifies each person who opens an account. We may request identifying information and documents, and may restrict, suspend, or close accounts to comply with anti-money-laundering, sanctions, and other legal obligations.
Applicable fees for currency conversion, transfers, or other services will be disclosed to you prior to completing a transaction. We may update our fee schedule from time to time with notice as required by law.
We may suspend or terminate your access to the Services, or close your account, if we reasonably believe you have violated these Terms, applicable law, or if required by our bank partner or a regulator. Notice will be provided where required by law.
To the maximum extent permitted by law, Fluenx is not liable for indirect, incidental, or consequential damages arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.
Any disputes arising from these Terms or the Services will be resolved as set forth in any separate arbitration or dispute resolution agreement provided to you at account opening, to the extent permitted by applicable law.
We may modify these Terms from time to time. You will be notified of material changes, and continued use of the Services after changes take effect constitutes acceptance.
